Article 3 – Applicability

3.1 These terms and conditions apply to every offer we make and to every agreement concluded.

3.2 Before you place an order, we make these terms and conditions available to you in a way that allows you to save them. You can consult and download them on our website at any time.

3.3 The version of these terms and conditions that applies to your order is the version in force at the time you placed the order.

3.4 Deviations from these terms and conditions apply only where we have agreed them with you in writing or by e-mail.

3.5 If any provision of these terms and conditions is void or is annulled, the remaining provisions remain in force. In that case we will consult with you on a replacement provision that reflects the purpose of the original provision as closely as possible.

3.6 These terms and conditions are also available in Dutch. In the event of any discrepancy between the Dutch and the English version, the Dutch version prevails. This does not affect any mandatory consumer protection that applies to you.

Article 4 – Offer and agreement

4.1 Our offer contains a complete and accurate description of the item. Obvious mistakes or clerical errors are not binding on us.

4.2 The agreement is concluded at the moment you accept the offer and meet the conditions attached to it. We confirm your order by e-mail without delay.

4.3 We may refuse an order or attach specific conditions to its fulfilment. If we refuse an order, we will inform you within three working days of receiving it and will refund any amount already received within fourteen days.

4.4 For items made to your specifications, the agreement is only concluded once you have confirmed the specification and the price in writing or by e-mail.

Article 5 – Prices

5.1 The prices stated are in euros and include VAT. Shipping costs are stated separately and are visible before you complete your order.

5.2 For deliveries to consumers within the European Union we charge the VAT rate of the country of destination. For deliveries outside the European Union we do not charge Dutch VAT; customs duties, local VAT and clearance costs are payable by the recipient.

5.3 The price applicable at the time of your order is the price we charge. We do not pass on price changes occurring after the agreement has been concluded.

Article 6 – Payment

6.1 Payment is made using the payment methods offered during checkout. Our payments are processed through Mollie.

6.2 If you choose to pay later or to pay in instalments, that payment agreement is concluded directly between you and the payment provider concerned. In that case we act solely as an intermediary. Your payment obligation is then owed to that provider and not to us, and that provider’s terms apply to that agreement.

6.3 If you return an order that you paid for using a pay-later or instalment arrangement, we will notify the provider concerned so that your payment obligation is adjusted.

6.4 If an amount unexpectedly remains outstanding to us, we will first send you a free reminder allowing you fourteen days to pay after all. If you do not pay after that, you owe statutory interest and extrajudicial collection costs in accordance with the Dutch Decree on compensation for extrajudicial collection costs (Besluit vergoeding voor buitengerechtelijke incassokosten).

6.5 You may report inaccuracies in the payment details provided to us at any time.

Article 7 – Delivery and risk

7.1 We deliver to the address you provided with your order.

7.2 The delivery time is stated in the product description of each item. That period counts as the agreed delivery time. If no delivery time is stated for an item, we deliver within thirty days of the agreement being concluded.

7.3 If we are at risk of not meeting an agreed delivery time, we will let you know as soon as possible. You may then choose whether to wait for your order or to cancel the agreement free of charge. In the event of cancellation, we refund the amount already paid within fourteen days.

7.4 The risk of damage or loss passes to you at the moment you physically take receipt of the item, or a third party designated by you does so on your behalf. If you yourself opt for delivery to a neighbour or to a collection point, that delivery counts as receipt. If the carrier decides to do so of its own accord without you having requested it, the risk remains with us until you have collected the item.

7.5 If your parcel has not been delivered two working days after the announced delivery date, please report this to us. We will then open a trace enquiry with the carrier. If the parcel has not been located within five working days after that, we will send a replacement free of charge or refund the full purchase amount. You do not have to wait for the carrier’s investigation to be completed.

7.6 Please report transport damage within two working days of receipt, with photographs of the packaging and the item, and keep the packaging.

Article 8 – Right of withdrawal for consumers

8.1 As a consumer you have the right to cancel the agreement within fourteen days of receiving the item, without giving a reason. Where an order is delivered in several shipments, that period starts on the day you receive the final shipment.

8.2 You notify us of your withdrawal by e-mail, using the model withdrawal form, or in any other unambiguous manner. A return number is not required in order to withdraw, but it helps us process your shipment more quickly.

8.3 After notifying us, you have a further fourteen days to return the item.

8.4 During the cooling-off period you must handle the item and its packaging with care. You may unpack, inspect and assess the item as you would in a shop. If you go further than is necessary to establish the nature, characteristics and functioning of the item, you are liable for any resulting diminution in value. The way in which we determine that diminution in value is described on our returns page.

8.5 The cost of the return shipment is payable by you. You may use our return label for this; we deduct its cost from your refund. Return shipments must carry sufficient postage. We do not accept shipments sent cash on delivery or with costs charged to the recipient; if such costs are nevertheless charged to us, we will deduct them. If a shipment is sent to a collection point or to an address other than the return address we provided, the actual costs of collecting the shipment from there are payable by you.

8.6 We refund within fourteen days of your notification, using the same means of payment you used and at no cost to you. We may withhold the refund until we have received the item or until you have demonstrated that you have returned it.

8.7 We also refund the shipping costs of the original delivery, up to the amount of our cheapest standard shipping option. If you return only part of your order, we do not refund those shipping costs.

8.8 If you return an item from a country outside the European Union, you must declare the shipment as a return of goods of EU origin, with the return number and a copy of the original invoice. Clearance costs and import duties charged to us as a result of an incorrect declaration will be deducted from your refund.

8.9 The right of withdrawal does not apply to items made to your specifications or clearly intended for a specific person. This includes, in any event, made-to-measure exhausts and link pipes, and other bespoke work. We draw your attention to this explicitly before the agreement is concluded and ask you to confirm it.

Article 9 – Conformity and statutory warranty

9.1 We warrant that the items comply with the agreement, with the specifications stated in the offer and with the requirements of soundness and usability that you may reasonably expect of them on the basis of the price and the nature of the item.

9.2 No fixed term is attached to this statutory warranty. How long you may expect an item to last depends on its nature and its price.

9.3 If an item turns out not to comply with the agreement, you are entitled to free repair or replacement. If a defect becomes apparent within one year of delivery, we assume that the defect was already present at the time of delivery, unless we demonstrate otherwise.

9.4 Please report a defect within a reasonable time after discovering it, stating your order number and including photographs where possible.

9.5 These statutory rights always apply. Any additional warranties as described in Article 10 are in addition to them and never limit your statutory rights.

Article 10 – Additional warranties

Dominator exhaust systems

10.1 We provide a five-year warranty on Dominator exhaust systems, counting from the date of purchase. This warranty applies solely to the original purchaser and is not transferable. You can claim under it on presentation of the proof of purchase showing the order number, name and e-mail address.

10.2 The warranty covers defects in construction and materials, namely: welds on the silencer, bends and link pipe coming loose or cracking, cracking or rusting through of the exhaust body, and delamination or burn-through of carbon.

10.3 The warranty does not cover:

  • dB killers that come loose, fall out or become clogged;
  • springs, clamps, gaskets, bolts, rubbers and silencer packing;
  • discolouration, tarnishing, surface rust on stainless steel and the discolouration of titanium caused by heat;
  • corrosion caused by road salt, winter use or deferred maintenance;
  • damage from drops, crashes and impacts;
  • damage caused by modifying the item, such as drilling, welding, shortening, coating or straightening;
  • damage caused by incorrect fitting or by not using the mounting materials supplied;
  • use in competition, on the race circuit or for stunt riding;
  • consequential damage to the motorcycle or to third parties.

10.4 Where a warranty claim is accepted, we will repair or replace the part concerned, at our discretion. In addition, we pay €100.00 per accepted claim as a contribution towards removal and refitting costs, on presentation of a workshop invoice in your name. This contribution never exceeds the purchase price of the item.

10.5 These additional warranties do not affect your statutory rights under Article 9.

Article 11 – Items not approved for road use

11.1 Part of our range does not carry European type approval and is therefore not permitted on public roads. This includes, in any event, catalytic converter replacements, de-cats and race exhaust systems. The product description of each item states whether it carries E-keur type approval.

11.2 We sell these items solely for use on closed premises or a race circuit. We state this on the item itself, so that you are aware of it before you order, and it is stated on your order confirmation.

11.3 If you use such an item on public roads, that is your own responsibility. We are not liable for fines, being stopped by the police, confiscation, the lapsing of the manufacturer’s warranty on your motorcycle or consequences for your insurance cover.

11.4 These items carry warranty for the normal use for which the item is intended, with the exception of damage from drops and impacts.

11.5 Your right of withdrawal under Article 8 applies in full to these items.

Article 12 – Fitting

12.1 We do not carry out fitting. Fitting is done by you or by a third party engaged by you.

12.2 We supply fitting instructions with our exhaust systems. Please follow them; damage caused by incorrect fitting is not covered by the additional warranty under Article 10.

Article 13 – Complaints

13.1 You can submit complaints by e-mail, stating your order number, a clear description and photographs where possible.

13.2 We respond within three working days. If your complaint requires more time to investigate, we will let you know within those three working days when you can expect a full answer.

13.3 If we cannot resolve the matter together, you may bring the dispute before the competent court in accordance with Article 18.

Article 14 – Liability

14.1 Our liability is not limited in cases where a limitation is not permitted by law, including intent or wilful recklessness on our part, damage arising from death or personal injury, and liability under product liability law.

14.2 Outside those cases, our liability towards consumers is limited to what follows from the law.

14.3 We are not liable for damage resulting from incorrect fitting by you or a third party, from use contrary to the item’s intended purpose, or from the use of a non-road-legal item on public roads.

Article 15 – Force majeure

15.1 If we are unable to deliver due to force majeure, we suspend our obligations for as long as that situation continues. If the force majeure lasts longer than thirty days, both you and we may cancel the agreement, without any obligation to pay compensation.

15.2 In the event of cancellation, we refund the amount already paid within fourteen days.

Article 16 – Retention of title

16.1 The items delivered remain our property until you have paid in full everything you owe under the agreement. This does not affect the passing of risk under Article 7.4.

Article 17 – Provisions applying to business customers

17.1 Articles 8 and 9 do not apply to business customers. Instead, the following applies.

17.2 There is no right of withdrawal. We do not accept the return of used exhaust systems, dB killers or catalytic converter replacements.

17.3 You must inspect the items on delivery and report any visible defects in writing or by e-mail within fourteen days of delivery. Any other defects must be reported within fourteen days of discovery. If you do not report in time, your claim lapses.

17.4 Risk passes at the moment the items are handed over to the carrier.

17.5 Stated delivery times are indicative and do not constitute a strict deadline.

17.6 Our liability is limited to the invoice amount of the order concerned. We are not liable for consequential loss, loss of profit or business losses.

17.7 If you do not pay on time, you owe interest of 1% per month without any notice of default being required, as well as extrajudicial collection costs of 15% of the outstanding amount, subject to a minimum of €150.00.

17.8 The additional warranties under Article 10 also apply to business customers, with the exception of the fitting contribution under Article 10.4.

Article 18 – Governing law and disputes

18.1 Dutch law applies to all agreements to which these terms and conditions apply. If you are a consumer resident in another country, this choice of law does not affect the mandatory consumer protection of the country in which you reside.

18.2 Disputes will be submitted to the competent court in the district of Amsterdam. If you are a consumer, you have the right to opt for the court designated as competent by law, within one month after we invoke this provision. If you are a consumer resident in another Member State of the European Union, the court of your place of residence remains competent.

Article 19 – Personal data

19.1 We process your personal data solely for the performance of the agreement and in accordance with the law. You can read how we do this in our privacy statement.

19.2 The privacy statement does not form part of these terms and conditions. Your acceptance of these terms and conditions does not constitute consent to the processing of your personal data.
